DocAccess End-User Terms of Use

IMPORTANT: By using DocAccess to read documents, you acknowledge that you have read, understood, and agree to be bound by these terms. If you do not agree to these terms, you must discontinue use of DocAccess immediately.

Acknowledgment of Service Purpose and Technology

By using DocAccess, you acknowledge and understand that:

  • DocAccess provides organizations with the ability to quickly and cost-effectively transcribe documents to make them accessible, promoting transparency and open communication
  • The technology employed by DocAccess, including artificial intelligence and machine learning systems, is experimental and continuously evolving
  • Such technology may have unforeseen limitations, errors, or side effects that could affect the accuracy or reliability of transcriptions and accessibility features
  • AI systems can "hallucinate" or generate content that appears accurate but may be incorrect, incomplete, or misleading

License to Read

DocAccess provides you with a limited, non-exclusive, non-transferable license to view and print documents for personal use only. You may not reproduce, redistribute, modify, or create derivative works from any content accessed through DocAccess without explicit written permission from both DocAccess and the document owner.

User Responsibilities and Verification Obligation

As a condition of using this free service, you acknowledge and agree that:

  • You will not rely solely on DocAccess transcriptions or accessibility features for important decisions without independent verification
  • You will use reasonable and available means to verify any critical information against the original source document
  • The original PDF document remains the authoritative and official record
  • You will follow the process outlined in our Accessibility Statement for reporting accuracy issues, requesting accommodations, or submitting claims

Prohibited Uses

You agree not to:

  • Use automated tools, bots, or scripts to scrape or download content from DocAccess
  • Perform bulk downloads of documents or transcripts
  • Modify, alter, or tamper with document transcripts or accessibility features
  • Use DocAccess in any way that violates applicable laws or regulations
  • Attempt to circumvent any security measures or access restrictions
  • Use the service for any commercial purpose without express written authorization

Comprehensive Indemnification and Hold Harmless

In consideration for being granted free access to DocAccess's visual interpretation and accessibility services, you hereby agree to indemnify, defend, and hold harmless DocAccess and its affiliates, officers, directors, employees, agents, licensors, suppliers, assigns, shareholders, customers, and any site operators using DocAccess to showcase their documents (collectively, the "Indemnified Parties") from and against any and all claims, demands, losses, costs, expenses, damages, and liabilities, including reasonable attorneys' fees, arising from or related to:

  • Your use of or reliance upon DocAccess services
  • Any actions taken based on transcribed or processed content from DocAccess
  • Your breach of these terms of use
  • Your violation of any applicable laws or regulations
  • Any claim that you failed to verify important information using reasonable means

Content Disclaimer and Third-Party Liability

DocAccess and the Indemnified Parties disclaim all responsibility and liability for:

  • The content, accuracy, completeness, or appropriateness of any documents processed through the service
  • Any offensive, inappropriate, obscene, unlawful, or objectionable content contained in processed documents
  • Actions taken by third parties based on information accessed through DocAccess
  • Any intellectual property infringement claims related to document content

Technology Limitations and AI Disclaimer

You expressly acknowledge and accept that:

  • Artificial intelligence and machine learning technologies may produce inaccurate, incomplete, or misleading results despite appearing credible
  • AI systems may "hallucinate" or generate content that appears legitimate but contains errors or fabrications
  • Transcription accuracy may vary based on document quality, formatting, language, and other factors
  • DocAccess makes no warranty regarding the accuracy, completeness, or reliability of AI-generated or processed content
  • Critical decisions should never be made based solely on DocAccess output without independent verification

ADA Live Assistance

DocAccess provides live assistance through our partnership with Aira, offering real-time support for users with visual impairments. This service includes up to 30 minutes of free assistance per session to help navigate and understand document content. Additional time may be available subject to availability and terms of service.

You acknowledge that calls with Aira are recorded for quality control purposes and to help DocAccess and its customers remediate accessibility issues. Call content is not shared or used for marketing purposes.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL STREAMLINE SOFTWARE, INC. DBA DOCACCESS™ OR ANY INDEMNIFIED PARTIES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, BUSINESS OPPORTUNITIES, REPUTATION, OR GOODWILL, WHETHER ARISING FROM YOUR USE OF THE SERVICE, RELIANCE ON TRANSCRIBED CONTENT, OR OTHERWISE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

Dispute Resolution Process

Before initiating any legal action, you agree to first follow the dispute resolution process outlined in our Accessibility Statement. This includes providing written notice of any claimed inaccuracy or accessibility issue and allowing DocAccess a reasonable opportunity to investigate and address the concern.

Governing Law and Venue

These terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law principles. Any disputes arising under these terms shall be subject to the exclusive jurisdiction of the state and federal courts located in California. You hereby consent to personal jurisdiction in such courts.

Severability and Enforceability

If any provision of these terms is found to be unenforceable or invalid, the remaining provisions shall remain in full force and effect. The unenforceable provision shall be modified to the minimum extent necessary to make it enforceable while preserving its original intent.

Changes to Terms

We reserve the right to modify these terms at any time with or without notice. Changes will be effective immediately upon posting to this page. Your continued use of DocAccess after any changes constitutes acceptance of the new terms. We encourage you to review these terms periodically for updates.

Entire Agreement

These terms, together with our Accessibility Statement and Privacy Policy, constitute the entire agreement between you and DocAccess regarding your use of the service and supersede all prior agreements and understandings.
